Sciammarella v. Peter Pan Restaurant (Carson’s Ribs), 11 L 12958
Trial Date: October 31-November 4, 2014
We represented Carson’s for Ribs in Chicago on behalf of its valet who knocked over the plaintiff while backing her car into Carson’s parking lot. The plaintiff stepped behind the car while trying to jaywalk across Wells Street to visit her accountant and the valet did not see her. The plaintiff’s injuries included a fractured wrist (open reduction, internal fixation) and assorted other injuries. Assessing 30% comparative negligence against the plaintiff, the jury deliberated 2 hours and awarded the plaintiff $171,893. The verdict was about half way between the plaintiff’s demand and the defendant’s offer.
